ABOUT FAMILY COURTS

 

      The Central Government enacted the Family Courts Act in 1984 with an intention to encourage prompt settlement of disputes dealing with family affairs and matrimonial issues. As per the Family Courts Act, 1984, it is an Act to provide for the establishment of Family Courts with a view to promote conciliation in, and secure speedy settlement of, disputes relating to marriage and family affairs and for matters connected therewith.

      Family Court proceedings may be held in camera if the Family Court so desires and shall be so held if either party so desires.

      A family Court exercises jurisdiction in relation to suits and proceedings of the following nature, namely:


a suit or proceeding between the parties to a marriage for decree of a nullity marriage (declaring the marriage to be null and void or, as the case may be, annulling the      marriage) ;or restitution of conjugal rights or judicial separation or dissolution of marriage;
a suit or proceeding for a declaration as to the validity of a marriage or as to the matrimonial status of any person;
a suit or proceeding between the parties to a marriage with respect to the property of the parties or of either of them;
a suit or proceeding for an order or injunction in circumstances arising out of a marital relationship;
a suit or proceeding for a declaration as to the legitimacy of any person;
a suit or proceeding for maintenance;
a suit or proceeding in relation to the guardianship of the person or the custody of, or     access to, any minor.

            In order to achieve the aims and objectives of the Family Courts Act, 1984, dedicated Family Courts have been setup under the jurisdiction of Punjab and Haryana High Court. At present, there are 10 Family Courts in Haryana (8 Districts) and 5 Family Courts in Punjab.
